"The Supreme Court has ruled that Government financial measures which are hitting British citizens who want foreign spouses or partners to join them in the UK do not breach human rights legislation".

I understand the need to c rack down on bogus marriages, although I doubt there are that many to make a huge difference, but the decision is basically saying that if you meet somebody from a non EU country and fall in love then you are immediately suspected of fraud.

The policy is wrong and the decision by the Supreme court to uphold it is wrong in my opinion.

You need to know someone in this position to understand just how bad it is & how much money some husabnds have spent on trying to bring their wives to the UK even though the children have British nationality.

It all started after 2010 & is very unpleasant being handled overseas by agencies not British Consuls

Unfortunately it's another example of EU freedom of movement causing discrimination against non EU migrants.

My other half is an immigration advisor and has told me that since 2010 the Home Office have started turning down visa or settlement applications for no apparent reason. As a result they have to appeal but then win the appeal almost all the time, so she thinks they do it just to discourage people. Sometimes it goes on for years, which must be terrible for the families.

I'd also point out the tightening of rules has been happening for years and is not something new.

Been married for 15 years, raised 5 kids, currently adopting our grandchildren and still have to jump through the same hoops!

Really? I moved back to the UK in 2006 with my then partner who was Israeli and the only requirement was to prove we'd lived together for two years in order to show it wasn't a sham. We weren't even married.

People have been taking the p1ss for years wth fake marriages and it's about time it was tackled.


There is an easy and more fair way to deal with sham marriages. How about making the spouse’s right to reside in the UK dependent on the marriage lasting for a minimum of five years so that if the marriage ended in divorce the foreign spouse would have to return home.

But it is wrong to penalise a spouse based on their earning potential..
