Clearly? Really? One's a parliamentary convention applicable to the HoC - the "club" 's rule book. The other's a public vote with the rules set out in a specific Act of Parliament. Two sets of rules for two completely different constituencies and different circumstances. The only tenuous comparison is that they're both related to "rules". There is a parliamentary convention about voting on the same issue in the same session twice. There's nothing to stop Parliament legislating for a second referendum/ peoples vote. Not a "motion of the House" - an Act of Parliament. There's nothing to stop the HoC voting to allow itself an exemption to Erskine May, although Parliament hasn't seen fit to do that since 1604 so it may be looked on a little strangely. The politics and PR around the issue are a different matter. Misstating the legal possibilities, as some Leavers (e.g. Esther McVey) are doing, is simply lying in order to mislead. | | | |
