Prosecutor Michael Mallon said Banks, a Tottenham Hotspur fan, was in central London to "protect statues", but admitted he did not know which statues

Guy is a moron (not a crime) easily led (not a crime) p*ssed (not a crime) needed a p'ss (not a crime) took a leek in public (minor crime) and didn't check where he went (stupid / disrespectful / idiotic) and ends up doing jail time?
Similar to the idiot who tried to set fire to the flag at the cenotaph. Yep, police have to act and he deserves punishing. But is jail time really an appropriate punishment?

The presence of those seeking the truth is infinitely to be preferred to the presence of those who think they've found it.
(Sir Terry Pratchett)
When you think about what some criminals get away with and get suspended sentences for assaults drink and drug drivers endangering people's lives etc. It amazes me how taking a pissed up slash next to that plaque gets you 14 days in prison within what less that 48 hours. Waste of time.
Should have made him go up Nelson's Column and clean the pigeon poo off it. It must be pretty bad up there by now since John Noakes & Shep stopped doing it.

He will serve no more than two or three days behind bars - guaranteed.
You are the obsolete SRN4 to my Fairey Rotodyne....
I'd also add I won't be losing any sleep over this. The guy was protesting against people protesting against racism. That makes him a racist, and I have very little sympathy for racists.
He's hardly a threat to society is he? Stupid thing to do, and I don't doubt the bloke is a moron but I would rather he's made to do community service, helping feed the homeless or something. What good is it doing anyone sticking him in prison for a fortnight.

Outraging public decency is an indictable common law offence which is punishable by unlimited imprisonment and/or an unlimited fine. To be guilty of this offence:
you must carry out an act which is lewd, obscene or of disgusting character, which outrages minimum standards of public decency as assessed by the jury; the act must take place in a public place, or a place which is accessible to, or within view of, the public; the act must take place in the actual presence of two or more persons who are capable of seeing it — it is irrelevant whether these people actually saw the act or were outraged by it.
So with fourteen days, he got off lightly. The scope for sentencing suggests it isn't seen as a minor crime.

What about the politicising of the justice system? You think you or I would get the same sentence if we had a p'ss on a saturday night out?

Depends on whether it was on a memorial to a dead police officer whilst we were taking part in a far right riot whilst claiming to be 'defending statues'. In those circumstances then yes, we probably would. If we were pissing in a doorway at 1am on a Sunday morning after an uneventful night out then probably not. You can't remove all context.

The context is he was p'ssed, needed a p'ss and was stupid to do it next to a plaque of a dead policeman.
The rest isn't relavant. If he did it next to the plaque to disrespect said policeman, he got off lightly. I doubt very much he did.
Drunken idiot, tick. Drunken right wing idiot, tick. Drunken right wing idiot intentionally causing public offence by disrespecting a memorial to brave policeman, don't buy it for a minute.

Apparently the judge was satisfied there was no intent to deliberately 'target' the memorial.
It seems ridiculously harsh to me however much of an idiot he is. A slap on the wrist and 14 days community service in a immigrant-focussed charity or similar would be a more productive and educational means of rehabilitation.

And the news report states there are mental health issues. Now that could be his brief trying it on, or it could be true.
With no assessment to send him to a prison (if it is true) could be highly detrimental to his welfare and for what? To keep the "String em up" brigade happy?
What an utter state the UK is getting itself into. Nonsense like this just distracts us from the real crimes and injustices going on.
I'd prefer they addressed the root causes of the far right, as well as the BLM protests, rather than supposedly dealing with unrest by petty law and order posturing.

As I said earlier in the thread, I think community service would have been more appropriate. But I'm also not going to lose any sleep over a pissed up racist getting harshly done by for acting like the hooligan he is.

This. If it's a miscarriage of justice, then a) it's pretty light and b) couldn't have happened to a better person.
Still, it'll give mummy and daddy who he still lives with a couple of weeks' respite.

He probably is, and probably voted for, the "string 'em up brigade"
