That which is necessary, is legal. Hence why the Gov's heavy handed approach to the Police, Crime, Sentencing and Courts Bill 2021is so universally unpopular. A "Fair Trial" means the timely application of the Law without fear or favour, and with access to decent legal representation. There is a massive backlog of trials, so the timely bit is in question. There is massive underfunding of Legal Aid, and morale is very low in criminal law. The recent anti-Protest clauses in the Policing Bill are such, though, that the bar is set incredibly low for conviction. Did you make a noise? Did somebody find the noise or your actions annoying? "Fair" application of these laws equals the outlawing of the right to protest. And look at how the Met policed the Sarah Everard vigil BEFORE this Bill had passed through Parliament for a flavour of how their new powers will be applied. We aren't living in Russia. But we are moving in the direction of post-democratic autocracy. | | | |
