Its a bit more complicated than that. Parliament is sovereign and, by definition, the law is what parliament says it is. Parliament can override its own statutes, or any part of common law.

There may well be arguments to have, but the fundamental issue is the behaviour of the government, rather than a realistic legal challenge imo.

The government is told by courts who have considered the evidence, that there is a safety issue. The government therefore declare those issues not to exist, by way of statute, irrespective of the evidence. It is simply dishonest, undermining the rule of law, and a very frightening authoritarian slippery slope. If they can do this, then they can remove other protections. But technically, they can. The issue is that until now, Parliament was largely populated by people who believed in proper behaviour in public office, integrity, and the conventions by which this country has succesfully been run for centuries. That is the mechanism by which this stuff ought to readily be prevented. The conservative majority is such, that it may not do so.

This is not the first Bill since Johnson became PM that has sought to disapply international law or the Human Rights Act but, as some who until 2011 drafted Government legislation, it would have been unimaginable under May or any previous PM to be asked to draft legislation such as this.

The rot set in under Johnson, and for all that Sunak was supposed to be an improvement in terms of competence and integrity, he is really no different when it comes to things like populism and disregard for the rule of law.

Starmer needs to highlight this loudly and repeatedly, including via large posters on the sides of buses, when it comes to GE 2024 - just what kind of party have the Tories become when Rwanda - yes, that's Rwanda - is taking the moral high ground over the UK regarding International law?!

And make sure the huge economic cost of the Tories' irrational, barmy, (non)immigration policies are driven home to those diehard political blues who still bizarrely think the economy is 'safer' in the hands of their lot rather than Labour.
