Rose Malster's solicitor Richard Buxton has commented on the latest action he and his client are taking against the new North Stand. Last week it emerged that Malster is to attempt to take her appeal over the council's decision to grant permission for the new stand to the European Court, a process which could halt work on the stand.

Buxton, based in Cambridge, says that if permission is granted by Appeal Court judges for the case to go to Europe then Town need to think very carefully whether to carry on with building work: "If the case is referred to Europe, the club will have to decide whether it wants to carry on with the building work - because to do so could be very dangerous for them to do so."

Malster and Buxton feel that Ipswich Borough Council's decision to give permission for the stand was wrong, Buxton again: "We believe the council was plainly wrong and acted unlawfully. Mrs Malster is hoping the whole issue will be looked at properly because that is not what has happened before. There should have been an environmental assessment."

Should they be given leave to European appeal they could seek an injunction to have work stopped. If the European Court find in their favour then a redesign of the stand may have to be carried out. However, an Ipswich Borough Council spokesman said he felt that the chances of the stand being knocked down or redesigned was "less than 1%".

If granted the European appeal could take as long as 20 months to go through.
