Anyone know the legal position when a company stops trading? 06:40 - Dec 1 with 811 viewsLegendofthePhoenix

Ordered a desk for a family member as a Christmas pressie in mid-November from a company called Brunswood. Money went out of my account. Didn't hear anything. Then my missus found out that on Facebook it says they stopped trading in October. Surely it is illegal to continue accepting orders once a company has stopped trading? Clearly someone must be in the office accepting orders knowing that they won't fulfill them!! Anyone have experience of this and know the best way to try and recoup the money?

The article says that if your Chargeback claim fails, you can appeal to the Financial Ombudsman.

It is probably worth doing this if you don't succeed at first, because debit/credit card companies will try to wriggle out if they can. I mention this because I put in a claim on behalf of my father-in-law to Nat West when he was scammed out of half his savings. Nat West allowed him to get some back but not all, but my appeal to the Ombudsman got it all back.

As has already been pointed out by others, the only channels to concern yourself with are the section 75 credit card and the debit card chargeback scheme.

I took a look at this company on companies house and all seems very odd! The company was always listed as "dormant" never filed a single set of accounts, then was actually dissolved by companies house on 14th December 2021, so the website should be closed and they certainly should not have been taking money for at least a year. If they ever actually fulfilled an order, I imagine the funds were going straight into a personal account and nowhere near a tax man.

I suggest you inform Companies House that they are still operating, despite being dissolved, which of course, is illegal.
