Ellen Bettley Smith on 22:54 - Sep 28 by jeera | There was evidence the male copper kicked DA in the head which is about as violent one human can be to another. I can see how Smith may not be deemed to have contributed directly to Dalian's death but cannot grasp how she wasn't [found] guilty of assault. There you go. She's got to live with her actions and he is in prison. None of that will bring back Dalian of course and it must be terribly hard on his family all round. |
Correct. This evidence adds to the weight of evidence against Monk. It would be interesting to know whether the tasering alone would have brought the manslaughter conviction. Indeed, I would suggest it is frightening the idea that it might not have done. I agree about Bettley-Smith's verdict. I suppose you cannot assault a corpse, but Dalian was clearly still alive at that point. How the case for self-defence can stand astounds me. She was worried he might be attempting to get to his hands and knees because if he got to his feet, she feared what he would then do. He was laid down unable to get up and it was her defence to claim that she worried he might attempt to get up! A terrifying verdict in my opinion. She will have to live with her actions. Somehow, I feel there is no remorse and I wonder whether she even regrets them much at all. Perhaps I am being unfair on her. However, she will one day get to face perfect justice. Monk is in prison, and I doubt it is a pleasant place for an ex-police officer. However, he will also be free in a few years. Spot on: None of that will bring back Dalian of course and it must be terribly hard on his family all round. They are the ones really living with the two officers' and lovers' actions every day of their lives. | |
