That's what I thought, although I may have read that on here and I suppose recommendations don't have to be followed up [?] Sounds a couple of years or so light to me given he would unlikely serve the eight as it is.

Twelve years was the prosecution's opening bid. The final result was always likely to be reduced from that.

"The offence was nearly five years ago. That has doubtless been an extremely difficult time for you and your family." Errrr......and for Mr Atkinson's family it must have been a breeze. [Post edited 29 Jun 2021 15:33]

The full sentencing remarks are worth reading but basically "kicking him in the head was ok because that wasn't a lethal weapon" (21). https://www.judiciary.uk/wp-content/uploads/2021/06/R-v-Monk-Sentencing-Remarks- Yes, I see why DAG thinks this will be appealed.

Just reading through now - no doubt at all this will be appealed.

This is the worst bit for me: "One witness said when Atkinson was kicked while on the ground his head snapped back. Monk was then seen with his boot rested on Atkinson’s head. Atkinson by then was barely conscious and would be pronounced dead within 70 minutes." So after kicking him in the head as hard as he possibly could, twice, he then stood about with his boot on his head afterwards. Those are not the actions of a "frightened" public servant trying to "restrain and control". Sounds like a terrible miscarriage of justice.
