Can someone explain the logic of this. 18:23 - Sep 27 with 1350 viewsPinewoodblue

A man has been sentenced at Ipswich Crown Court to 14 months imprisonment for illegally entering the U.K. in contravention of a deportation order.

He had previously been stopped from re-entry and been sent back.o

Why not just send him back again?

Presumably he will be deported again once he has served his sentence.

There's not a lot of detail in the newspaper report but. as they give an Ipswich address for him and refer to his wife (who may be English or have permission to reside in the United Kingdom) it sounds slightly complicated. Perhaps the idea is to start his sentence here and deport him to finish the term in his country of birth, once the paperwork has been completed ?

There is some process to follow - the courts can't deport rather than sentence people. The home secretary has a duty to issue a deportation order where a foreign criminal has been sentenced for more than 12 months and this can be complicated by appeals etc. Services have been cut to the bone all over the place and so not enough trained HO staff to do this quickly. People should be annoyed about this rather than trousers.

There might be an appeal over a point of procedure rather than the facts - having said that I'm not a lawyer!
