Wardley Ticket Refunds 15:22 - May 27 with 1513 views | Muncher | I've just called the Club to try and get a refund on some tickets I've bought for the Fabio Wardley fight for family members who aren't interested in going any more (partly due to the change of opponent) and the club have said they are only acting as agents for the promoters and the promoters won't issue any refunds at all. Has anyone else had the same response? They referred me to a section in the T&Cs but that doesn't deal with a change of opponent at all.

From what I've read elsewhere, the only real justification would be if the 'Title Fight' nature of the evening was to change. What does the paragraph to which you have been referred say? I would expect a boxing promoter to have pretty watertight T&Cs, but it would be interesting to see the wording.

These are the paragraphs which they sent me. There is absolutely nothing which says they can change the lineup, only the date and time of the event (para 10). 10. The date and time of the Event (and opening of the Stadium) are subject to change by the Promoter in its sole discretion. ITFC will inform Ticket Buyers of any date and/or time changes (including changes to the opening of the Stadium or Event) via the email provided at the time of purchase and Ticket Purchasers are responsible for monitoring their emails for such information. ITFC would also advise you to visit the Stadium website for confirmation of such details. 11. If the Event is cancelled in full and not rescheduled, or if the Event is relocated, closed to public attendance, or subject to capacity limitations requiring the cancellation of your Tickets, you will be provided a refund of the face value of your Ticket and any applicable booking/administration fee charged to you by ITFC in connection with your Ticket Purchase. If instructed by us to do so, you must return your unused ticket in order to receive any refund. Refunds will be processed using the same means of payment you used to purchase your Tickets. Your sole and exclusive remedy if the Event is cancelled and not rescheduled, or if the Event is relocated, closed to public attendance, or made subject capacity limitations resulting in your ticket being cancelled is a refund of the face value of your Tickets and any applicable booking / administration fee charged to you by ITFC in connection with your Ticket purchase and in none of the foregoing circumstances shall you be entitled to any other remedy (including, without limitation, damages for costs associated with travel, accommodations or other arrangements made by you in connection with the Event). 12. Without limiting the foregoing paragraphs 10 and 11, ITFC reserves the right to cancel your order at any time (even after the order has been accepted) in its absolute discretion for any reason and refund the face value of your Tickets and any applicable booking/administration fee charged to you by ITFC in connection with your Ticket Purchase. ITFC shall have no further liability to you in connection with the cancellation of your Ticket purchase pursuant to this paragraph 12. 13. ITFC's liability if (i) admission to the Event and/or Stadium is refused or withdrawn, (ii) the Event is rescheduled, cancelled and not replayed/rescheduled, relocated, closed to public attendance, or made subject to capacity limitations resulting in Ticket cancellations, or (iii) for any breach of these Terms and Conditions, any other applicable rules, or any other term of your Tickets, shall not exceed the face value of the Ticket and any applicable booking/administration fee charged to you by ITFC in connection with your Ticket purchase. Without limiting the foregoing, in no event shall ITFC be liable for any special, consequential, incidental, indirect or exemplary damages of any kind, including, without limitation, loss of enjoyment, or for any amount paid in excess of face value to a third party for your Ticket, or for any travel or accommodation costs and other personal arrangements and expenditures. All travel, accommodation, and other personal arrangements and expenditures are arranged at your own risk. ITFC will not be responsible or liable for any such arrangements or expenditures which may be wasted or unrecoverable, even if arising as a result of the Event being rescheduled, cancelled, relocated, closed to public attendance, or made subject to capacity limitations resulting in Ticket cancellations. 14. Except as expressly set forth in paragraph 10 and 11 above, your purchase of any Tickets is non-refundable and non-transferable.

It's an interesting situation, and probably one for someone with a better understanding of contract law than I. The Boxing T&Cs that you are asked to agree to when you purchase a ticket make multiple references to 'The Event', but don't seem to define what is meant by 'The Event'. Is 'The Event' simply World Championship Boxing, or is/was it Wardley vs Clarke? If it's the former, then Paragraph 11 applies and there would be no refund unless there is a full cancellation. The ticketing page seems a little ambiguous on this point - whilst the headline listing is 'Running Towards Adversity - Wardley vs Huni', it appears as if the Queensberry name for the event is simply World Championship Boxing. If it was tested in a court of law, and it was determined to be ambiguous, I would suggest a judge would look at what an average punter would assume to be signing up to. If you've purchased the tickets on a credit card, you might have possible recourse there.
