| Non-compete clauses 18:31 - Jun 10 with 577 views | Zx1988 | Anyone know how they tend to work in practice? I can't imagine that a blanket ban on any football-related work anywhere in the world would be enforceable. Does it usually concern direct rivals, which would then open up an argument concerning what actually constitutes a direct rival? | |

So Ashton can scream that we're protected until he's blue in the face, but if another club decides to call his bluff, there'll be no hope in hell of enforcing things?

Don't confuse non-compete (prevention of taking another role for XX months) vs compensation (club gets £XM if he takes a job in nxt 12 months) - different legal mechanisms and one far easier to enforce than another. What I am saying is that preventing a manager from taking another role for XX months is unlikely, but seeking agreed compensation for taking that role within XX months is far more legally enforcable.

When he returns to football he would therefore be a free agent, is this about right?

This is exactly it. If what we understand to be written in the contract is correct, with timelines and amounts, that will be highly enforceable. Incidentally if Kieran really wanted out of his contract to go elsewhere, then he could have contributed to the buyout compensation.
