Work holiday pay question 09:32 - Jan 26 with 744 viewsThe_Flashing_Smile

if you're made redundant and have outstanding holiday entitlement, and the company has agreed to pay you for the holiday you didn't use, that should be the same as your daily pay rate shouldn't it? There's no loophole that says taking the money instead of holiday means it's worth less is there?

Yep, should be equivalent to your daily rate. In the same respect if you left and had taken more holiday than you had accrued through the period, they could ask for it back / deduct it from your final pay.

Assuming that your salary has remained unchanged for the duration of the period for which that holiday accrues then no can't see that they can do that. Had your pay increased then pro-rating the holiday pay might be appropriate.

Is this associated with furlough pay?
Obviously some companies are paying furlough at 80%, if you take holiday in that time (we’ve had to do this for staff due to the length of time we’ve been closed) you still have to pay 100% for that period. This is obviously a nightmare for us, we’re already paying about £2k month taxes on the pay, add in holiday top ups it’s quite a cost for a closed business. But it has to be paid!

Yes. Although presumably the company could offset your holiday entitlement against your notice period if it wanted to (ie if not making you work it).

It was exactly that way for me when I left a relatively small company (120 employees), though that’s a good few years back now.

No, nothing to do with furlough.
