The Judge has been very strong. She went beyond the maximum guideline for sentencing (4 years) due to the social harm and distress caused, and due to them revelling in the crime and the fact that others had been arrested for their crime.
Sentence 4 years 3 months.
They will serve a minimum of 40% in prison (approx 20 months).
What's the feeling on that sentence?
I am aware that some "one punch killers" have been given shorter sentences than that, for example. I am concerned that the Judge said that the widespread public response was a factor in increasing the sentence. That suggests that social media campaigns could influence sentencing.

This is exactly what I feel too. There's a creeping subjectivity coming into too much of our law. As one example, I'm allowed to sunbathe nude in my garden, unless it annoys my neighbour and they complain about it, in which case I may be guilty of harassment and/or indecent exposure. I mean, what's the world coming to when a man cannot let it all hang out in his own back yard. Madness. |

Exactly, the perpetrators are idiots but no threat to the public. Community service is a far more rational sentence than prison for such people. However, imagine the populist outcry if this had been the result. Populist politicians are bad enough, but populist judges?!? |
With the community service fitting the crime - fly tippers having to tidy up urban and rural areas for so many weekends of a year. And make community service a lot more of an inconvenience to someone’s free time whilst allowing them to work. | | | |

Beyond stupid as a sentence. Prisons are overcrowded, so let's put these 2 up for a couple of years. They're clearly idiots, but putting 2 fools in jail for 4 years for damaging a tree? |
Damaging a tree? So if somebody gets a bulldozer out and demolishes Stonehenge, that’s ok? It’s only a load of old stones. So if HMS Victory or SS Great Britain are set fire to and destroyed why worry? Only a couple of old boats. How about letting people tear up and destroy whatever they like. It’s only old buildings and stuff. Heritage? Beauty? Who cares.
Well actually I do. People that deface, destroy, vandalise, selfishly take and don’t give a monkeys what effect it might have on the environment, people’s lives, future generations are the scum of the earth as far as I’m concerned.
However prison with me paying for it? That’s no solution. Two choices. Hard labour for five years anything from litter picking off duel carriageways to forestry work. Not bothered but something that makes these a’wipes contribute to society rather than detract from it. If they refuse, removal of a hand or donation of a kidney as a permanent reminder that there’s a consequence and often cost for every action.
A tad Hammerabi / harsh / brutal maybe? Obviously I’m not being serious but people should be made to pay for their actions. It wasn’t ’just a tree’ and it wasn’t theirs to destroy. |  | | |

It's a difficult 1 really. I'm not sure how fitting a custodial sentence is but a few hours community service on a Sunday morning is really no deterrent.
Your right that our cultural heritage as to have a value beyond 'it's just a tree' or 'just a boat'. I guess the question then is how entwined with the nations cultural identity is the sycamore gap tree?
I have to confess to barely being aware if it til this controversy. Its hard to argue that it's at the same level of importance as Stonehenge or the other examples you give.
But I'm sure to many it's loss will be felt just as strongly.
The other slight issue for me is how many 100 plus year old trees are removed for large infrastructure projects like the HS2 etc. I know a motorway or high-speed railway is not about to pass through the sycamore gap, but if this tree was in the planned route of such a project, it would have been instantly removed and its cultural importance downplayed. | | | |

The judge went slightly over the max - but for me, got no issues as it wasn't like she doubled it.
I think the social harm was real and the process for the punishment doesn't concern me.
The wider point (on could a social media campaign influence sentencing) - I guess that's a worry - but I think she was influenced by public anger not public campaigning.
So on balance - feels about right.

The geezer from probation who drove us there in a minibus would stay in the van reading jazz mags, and we just used to hide round the back of the church smoking spliffs lol. |
I to had a misspent youth and did a bit of community service. Like you say was a bit of a joke. Spent a few Sunday mornings tidying some old folks gardens, bit of painting of Haverhill boxing club, an old folks home etc.
Use to last 3-4 hours but counted as 8 hours off yer total .
The highlight for me was 1 Sunday afternoon as the probation bloke was driving us home we drove past 2 well dressed ( for Haverhill ) ladies fighting in the street. He instantly stopped the van and reversed up to the fighting ladies. I expected he was gonna attempt to separate um, but instead he just pulled van up alongside um so all the retribates inside could get a good view of the action. The 2 ladies then united in their dusgust of the driver and started shouting and threatening him. At which point he drove off scared, much to the amusement of the 2 fighting ladies and everyone in the back of the mini bus.

I did it with 2 mates, and apart from having to get up on a Sunday morning in the middle of the rave period it was quite good craic.
Though there was a group of teenagers who were just robbing everything. I'd never seen anything like it. They should never have been let anywhere near old people's gardens. Would just throw stuff into the bushes and come back for it later. They eventually got their comeuppance when they stole petty cash and punch bags from boxing club.. Justice | | | |
