This passage early on is pretty simple..

"If any of you will own or part own more than one residential property worth £40,000 or more, you will have to pay the higher rates on your new purchase (unless there is another reason why the higher rates do not apply).

Include any residential property that:

is owned on behalf of children under the age of 18 (parents are treated as the owners even if the property is held through a trust and they are not the trustees)".

It's very difficult to believe that any conveyancing solicitor would not know this, assuming they were aware of the trust.

EDIT: she apparently said she only knew the position when she went to a KC but it doesn't need a KC to read clear and plain HMRC advice.

Yeah doesn't look to difficult to find and you expect and "expert" to know this and if not, be able to look it up.

Be interesting to know who she got advice on and what they said. Did they think they had some kind of loophole and it's gone wrong?

So what you're saying is that it could be the solicitor's fault?

My point to lowers being that it would not necessarily be that easy for Rayner to parse all that info (including any caveats) herself, other than to say to any advisors, "Make sure all the rules are followed please and I pay what I'm supposed to", otherwise she might as well do everything herself...


I think it is unlikely it is the solicitors' fault if they knew the facts.

But it is possible that Rayner thought that she no longer owned any other property and so didn't disclose the trust to the solicitors.

Whatever the case, I don't think she should be expected to know of the HMRC advice.

She is toast. If she was a Conservative imagine the outcry! This lady is in charge of our national housing policy & can't sort her own affairs. Not good enough. She can squirm all she likes, but she's done for. In life what goes around tends to come around. It's disappointing that a young politician is in this position but unfortunately it's something which will be a good lesson. We need better.

are you saying that female politicians or labour politicians shouldn't be held to high standards? reading the hmrc website - the sections written for the public - is basic scrutiny.

when i've bought houses i've used the hmrc website and their stamp duty calculator. if i had the complication of a child's trust i would go there to see if there was a simple answer.

i started thinking that rayner was the victim of an advisor's error - but i'm struggling to see that she could really have asked a serious advisor.

And so as the loose-bowelled pigeon of time swoops low over the unsuspecting tourist of destiny, and the flatulent skunk of fate wanders into the air-conditioning system of eternity, I notice it's the end of the show

If it turns out that she asked some close friend "as a favour" to sort it out for her and they didn't really know what they were doing, then I'll concede the point to you, but if it was an established company with good trustpilot reviews making such an error, then that's litigation territory..

It’s a shame but she has to go. Your position is untenable if you can’t follow the rules, however complex. She’s been a target for years, this will be the final nail.
On the plus side, 18 months on the backbench is normally sufficient punishment/rehabilitation, so there’s a pathway back to Cabinet.

Is it harsh? If a socialist politician is inclined to buy multiple properties whilst mortgages and rents are at historic levels, it’s very difficult to find sympathy if they fall afoul of their own tax rules - not an issue for 99pc of us.

All the ‘tax companies and wealthy more’ and hey a perfect example of legal tax avoidance by the wealthy (whether intentional or not)….
