And then there's the pure variety...

Netanyahu had said last December that even to subject Israel to any war crimes investigation amounted to “pure antisemitism”.

Hamas’ and Netanyahu’s regimes are two cheeks of the same arse. It’s about time the international community got serious about both of them. Not that they will with Israel (see China and Russia, albeit for different reasons).

Interesting times. If the genocide isn’t countered, I wonder how many more rogue regimes will be given free reign to do what they want.

Biden is already laying down the rules, it's never going to happen.

I will be interested to hear which of the much lauded definitions applies to this latest example of antisemitism.

It's not new for the Israeli government to hide behind accusations of anti-Semitism. He would clearly say anything to deflect attention and blame.

The Prosecutor of the ICC was assisted by a panel of mainly British experts in International Law including Amal Clooney and Helena Kennedy. Two of them, Danny Friedman KC and Judge Theodor Meron, are even Jewish.

Given this, accusations of antisemitism are complete nonsense, and would suggest that Israel could never commit war crimes.

There is also a certain hypocrisy involved because Biden, who described the decision to seek an arrest warrant as outrageous, welcomed with open arms the decision to prosecute Putin for war crimes.

As it is, Israel and the US don't recognise the ICC (as doesn't Russia), so if an arrest warrant is issued for Netanyahu, he would be safe going to the US, but (just like Putin) it might affect his travels elsewhere.

Good to see Labour sticking up for the international rules-based order, unlike the Government or Biden.

This from the Telegraph.

Labour has called for Benjamin Netanyahu to be arrested if the International Criminal Court (ICC) issues a warrant for his arrest.

David Lammy, the shadow foreign secretary, said that the UK and all parties to the Rome Statute, which underpins the ICC, “have a legal obligation” to comply with its warrants.

He spoke out after the UK Government said that it did not recognise the jurisdiction of the ICC in the conflict between Israel and Hamas, and refused to confirm whether it would comply with a warrant should one be issued.

Mr Lammy told the Commons yesterday: “Arrest warrants are not a conviction or determination of guilt, but they do reflect the evidence and judgment of the prosecutor about the grounds for individual criminal responsibility.

“Labour’s position is that the decision by the International Criminal Court chief prosecutor to apply for arrest warrants is an independent matter for the court and the prosecutor.

“And Labour believes that the UK and all parties to the Rome Statute have a legal obligation to comply with orders and warrants issued by the court. Democracies who believe in the rule of law must submit themselves to it.”

Lammy also said his opposition Labour party “supports the ICC as a cornerstone of the international legal system . . . whether it is in Ukraine, Sudan, Syria or Gaza”.

Mr Lammy called on the Government to make the same commitments, asking:
“Does the Conservative Party, the party of Churchill, who was one of the founders of our international legal framework, does the Conservative Party believe in international rule of law or not?”

France too.

France says it supports the independence of the international criminal court (ICC), after its prosecutor requested arrest warrants for leaders from Israel, including prime minister Benjamin Netanyahu, and those from Hamas.

In a statement released late on Monday the foreign ministry said “France supports the international criminal court, its independence, and the fight against impunity in all situations,” reports Agence France-Presse.

The ministry “condemned the antisemitic massacres perpetrated by Hamas” during the group’s attack on Israel on 7 October, which was “accompanied by acts of torture and sexual violence”.

It also said it had warned Israel “of the need for strict compliance with international humanitarian law, and in particular of the unacceptable level of civilian casualties in the Gaza Strip and inadequate humanitarian access”.

This from Haaretz.

If the International Criminal Court issues arrest warrants against Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant, it would complicate meetings between the Israeli leaders and leaders or foreign ministers from countries that recognize the court's jurisdiction, diplomats from several countries supportive of Israel told Haaretz.

"It would be like meeting with Putin" said one diplomat from a country that supports Israel, who compared the potential warrants to those the ICC issued against the Russian president and senior members of his military over suspected war crimes related to the war in Ukraine.

The diplomat estimated that if the warrants are indeed issued, "we would continue to maintain regular ties with Israel on many levels, but there wouldn't be personal meetings with someone with such a warrant against them."

Like other diplomats who agreed to discuss the topic, the diplomat asked for his name and the country he represents not to be identified so as not to damage ties with Israel at a stage where the arrest warrants are not yet an inevitability.

The Western "rules-based international order"? My arse!

https://www.theguardian.com/us-news/article/2024/may/21/blinken-icc-court-prosec

The Biden administration is willing to work with Congress to potentially impose sanctions against international criminal court officials over the prosecutor’s request for arrest warrants for Israeli leaders over the Gaza war, Antony Blinken, the secretary of state, said on Tuesday.

The United States is not a member of the court, but has supported past prosecutions, including the ICC’s decision last year to issue an arrest warrant for Vladimir Putin, the Russian president, over the war in Ukraine.

In 2020, Donald Trump’s administration accused the ICC of infringing on US national sovereignty when it authorized an investigation into war crimes committed in Afghanistan. The US targeted court staff, including then-prosecutor Fatou Bensouda, with asset freezes and travel bans.
