In May 2023 I created an account with a company based on an Instagram advert which, after doing so, transpired to be a massive data-harvesting exercise. I requested that they delete my data, and a few days later submitted a Subject Access Request. The SAR was acknowledged, and they confirmed that my data had been deleted. In August 2023 I received further targeted marketing from them - I asked why this had happened and chased up the SAR, and received no response. In November 2024 I had more marketing, and had further communication with the company regarding their ongoing failure to delete my data, and failure to respond to the SAR. I chased up the SAR again and, again, they confirmed that my data had been deleted. I've received another targeted email from them today, so they've still not deleted my data, and still haven't responded to the SAR. Just how bad would this be for them if I took the matter to the Information Commissioner? Are we now at a stage where I should be requesting compensation from the company? |  |

But you could certainly escalate it if they’ve been ignoring your requests. Although can you prove they haven’t got your information from another source (companies are selling data all over the place)? |  |

Good point. It feels as if it would be one hell of a coincidence if they finally deleted my data in November, and were then suddenly sold my data last month. I'd never heard anything from them prior to giving them my details, and they confirmed back in November that they'd dropped the ball in deleting my data. Of course, them responding to my nearly two-year-old SAR would help piece that particular jigsaw together. I think they're somewhat concerned about the consequences, as they sought to placate me back in November by sending me a >£100 bottle of wine... |  |
