Who bears the burden of proof in this sort of situation? If the parents have signed an affidavit, does the buck stop with them? Or would a national newspaper be expected to undertake further due diligence regardless of the legal sureties offered to them? |  |

If it's a newspaper worth its salt and it's making allegations that amount to a criminal offence then do you think there is a duty on that newspaper to do more to confirm the story than just rely on their source's word? |  |

This begs the question, who authorised the publication of the story Something like this would have needed authorisation from high up, not from night subbie. As to responsibility is is similar to shouting "fire, fire" in a packed cinema, when you know there is no fire. What responsibility to any folk injured do you bear ? If this woman was doing this when she was 17 and the mother knew, as she claims, then why not inform the police, or at least contact the website hosting her ? Or was the mother OK with it, as the money was good ? Or perhaps they did, only to be told that as it involved two consenting adults it was not a criminal offence - so the mother decided to go to the media. When asked if she was at any time under age, it is not unreasonable to think the mother might go along with that bit to ensure the story came out in the open. I doubt the mother seeking publicity/fame etc she just wanted her daughter to stop taking drugs. Any 'duty of care', the Sun might be presumed to exercise, went out of the window. What minimal amount it ever had, that is. Its reckless action in publishing this after being told not to by the alleged victim ensured that half a dozen or more BBC presenters were under suspicion of being the person involved in paedophilia. Men have been killed where wrongly accused, and in one case spent over 20 years in prison. And I can't help feeling that the authorisation for publishing this story came from the very top..........kindly old Rupe.
