They manage to smash the driver side mirror, the car was also in a filthy state, having spent days on a tour of East Anglia. Booked in for estimate this morning so had it given a good clean. The damage is not limited to mirror, bonnet is seriously scratched, non metal parts to both driver side doors deeply scored and a two foot plus crease to the roof. I only found out when my garage asked what RAC were going to do about the damage. Any experts on here, how easy is it to repair a car roof? |  |

That will be the interesting question - it wouldn't at all surprise me if there is something in RAC's T&Cs which covers incidents such as this, and potentially places the onus on the owner to go through their insurer. One way to get around this, if RAC don't want to play ball, may be to plaster the incident all over Facebook/X/LinkedIn with pictures of the damage, and something along the lines of 'look what RAC did to my car'. |  |

They will.Before I knew of the damage I sent them a detailed statement saying it had been written with a mind to having to submit it to civil court as evidence. Gave them 48 hours to respond and 21 days to complete their enquiries. Complaint transferred to executive and they promise to complete enquiries and report back by 30th June. I won’t boor TWTD with the complete saga. |  |

Actually I think that the OP may have to pursue the 3rd party company for any damage to the vehicle. The company that physically transports the vehicle is liable for any damage caused during the process. This is because they are the ones in possession and control of the vehicle during the transport. I’m pretty sure that when your vehicle is collected, you will have had to sign paperwork, and at that point the liability is assigned. |  | |  |

All depends on the contract etc., OP's contract is with RAC, therefore it is their liability even should they choose to subcontract the work. Fennelly v. Connex South Eastern Ltd. broadly covers this sort of thing. A ticket collector employed by Connex assaulted and injured a passenger. The Court of Appeal held that it was correct to hold Connex liable for the injuries, on the basis that they were inflicted by their employee. Also, privity of contract means that third parties legally cannot enforce the terms of a contract, even if it was made for their benefit, except in very specific circumstances. Could have done with some Twtd hive mind assistance back in the day. First one was when TNT delivered a computer that was literally in bits after it had clearly been thrown around in the back of a van. Worst one was when I foolishly put a computer in the hold of a plane, in a brief case. Again laptop was in pieces, the brief case literally had a tyre mark where it had been run over. Both cases got told to fck off and "read the small print". Think I got TNT to make good the damages but only cos I threatened to get them delisted as a supplier to my company. |  |
