Is anyone more clued up than me able to explain… 14:30 - Aug 15 with 1136 viewschantryblueboy

How a jury can watch the clip of this bloke and find him not guilty of inciting violent disorder?

Councillor cleared of encouraging violent behaviour https://www.bbc.com/news/articles/cjeykklwn7vo

Not trying to draw any false equivalences with the Lucy Connolly case as I understand that she pleaded guilty. Just don’t understand how this verdict can be reached

cos incitement usually requires intent.

And so as the loose-bowelled pigeon of time swoops low over the unsuspecting tourist of destiny, and the flatulent skunk of fate wanders into the air-conditioning system of eternity, I notice it's the end of the show

Intent for him to do it or for someone to follow his instructions? Seems a tricky one to argue against if it’s the latter given he would have had no idea who was in the crowd

intent to incite. was he really seeking for someone to go and do it? seems implausible to me but i haven't seen the details.

i also find it hard to believe that in the other case there was intent - but being said in the middle of on-going riots makes intent much more of a possibility.

The other case involved a guilty plea though, so the only thing you can really argue is how harsh the sentence was - which I do think was incredibly harsh.

I still think if I was in the jury I’d have found him guilty, but guess I can see where the doubt comes from. Cheers

First line of the sentencing remarks:

"Lucy Connolly you have pleaded guilty to the offence of distributing
material with the intention of stirring up racial hatred."

https://www.judiciary.uk/wp-content/uploads/2024/10/Connollysentence.pdf

***EDIT***
And an added bonus:

"In relation to your culpability this is clearly a category A case – as both
prosecution and your counsel agree, because you intended to incite
serious violence."

The sentence is explained well here:

Given the law, the sentencing guidelines and her guilty plea the court had little choice, seemingly.

So intent was baked into the charges. She was actually on her phone at home presumably while this guy was out and about on a megaphone.

The right are going to latch onto this and we need to be very clear about treating people the same. Has the man been treated differently because the recipient(s) were "bad" people and should this make a difference?

I think it is worth bringing clarity, so people don’t conflate the two.

One pleaded guilty.

The other pleaded not guilty, and was found not guilty, by a jury.

So you seem to be agreeing.

Nothing to conflate.

People accused of a crime, can choose to plead guilty or not guilty.

One person decided to plead not guilty, another chose to plead guilty.
