As I point out above- the practicalities are problematic. By its very nature, domestic violence tends to have only two good witnesses. Getting a conviction on the "beyond reasonable doubt" evidential burden, with only one of those witnesses, who also happens to be the defendant, is obviously rare. |  |

I feel the law should always decide that question. The victim has an opinion but the law is there to protect society so should have the last say. Did he get off lightly? No idea. Too many unknowns and I don't know the sentencing guidelines [Post edited 7 Jul 2020 20:12]

If CPS are confident that an incident of domestic abuse has occurred, then yes. It should be remembered that domestic abuse is rarely just a single violent incident, but usually follows a pattern involving significant manipulation and control. My missus works in the justice system and had a case where a woman had her face deliberately sliced up by her partner when he was angry at her. He had history and was known to the police, but she didn't want to proceed, when it went to trial she wanted to testify FOR him, she tried to visit and contact him in prison. It's a difficult question about whether to proceed without the victim, but the answer should never be a default of "no". |  | |  |
