He hasn't escaped from jail - they let him go rather than detaining him (for deportation) at the end of his sentence.

it's not just the threat it's the incitement of others. if words are intended to incite others and are likely to incite violence then it's serious stuff. but 'if' is a big word in this.

Yes i was generalising there. If the person wasn't on twitter but using the same words through a megaphone directly outside the hotel the sentence would be more fitting.
