Extension 17:47 - May 16 with 1604 viewsLeoMuff

Neighbours have been round to chat through extension plans, which are hard to picture when looking on paper but it feels like it would be quite overbearing and impact light into our bathroom.

Did mention that going out beyond our house would Impact our rather nice view which was rather brushed over.

Anyone know where to seek impact advice if possible or had any experience of this ?

It’s hard to decide how it impacts really, Doesnt feel life changing as it’s a bathroom, but it’s nice view and the light from the bathroom window goes through top of the house.

Was just asking if anyone knew where to go for advice, if there is such a thing

I'm a visual guy.. are you able to post a rough drawing as to what it'll look like? (Doesn't have to be architect standard)
Are you detached/semi detached with said neighbour? Roughly how far out will the extension be?

If it’s overbearing that might be a ground for a planning objection. Putting planning aside there’s no right to a view in English law but if it infringes any right of light you have to your window that may be the basis for illegal action

For advice on planning find a good planning consultant. Otherwise a surveyor who specialises in neighbourly matters could help. Via the RICS website you a find a firm that will offer 30 minutes free advice.

Is it on top of an existing structure, or a new structure?

If it's the latter and they're building up to or close to the boundary, you'll have rights courtesy of the Party Wall Act, and should be able to appoint a specialist surveyor to represent you at the neighbours' cost.

On top of the existing structure, our houses are semi detached, ours has an existing extension build before we brought. There is set back from ours, but want to build on top and out to about 8 ft beyond our house and build up to the same height.

Feels like it would be quite instructive and block some light, would the party wall surveyor comment on that or solely on structural aspect ?

The PWS would be there to, effectively, represent the boundary/party wall. They would come into play should planning be granted.

In the meantime you'll need to wait for the formal application, and then make your representations based on the proposal. ChatGPT can be very helpful in making sure that any objections are based on policy reasons (which matter), rather than immaterial considerations.

The one potential issue that I'd be mindful of is not inadvertently turning the matter into a neighbour dispute, as that could have serious implications should you wish to sell in the short to medium term. Planning matters can be a strange and emotive beast.

As someone else said, a right to view unfortunately doesn't count for anything in planning, but there's a number of potential material planning considerations that we can look at.

I’m no expert, but can you search previous local planning decisions for similar structures which were either allowed or denied? Might help you make an objection if you want to.

Round here, there’s a building that so closely resembles a detached house that it is one in all but name - but was given permission only as a “storage shed”. All locals are certain that the planning committee were given bungs for it to pass muster. People travel from all over the area (which is North Yorkshire, so very large) to photograph it so they can say re their own similar applications “but you passed this …”.

For what it's worth, the fact that your neighbours have had a discussion with you is a very good indication that they might be reasonable people. I would suggest considering if a similar extension is feasible for you. Both my parents, and my sister/husband considered a mutual extension to avoid view-blocking.

Open, honest communication will be key here.

I was in the building trade most of my working life,hod carrying for some 30 years then bricklaying.

I’ve worked on countless house extensions etc,my one word of advice to you is if they need to access your garden to build the extension ie with scaffolding etc,I know it’s a nuisance but let them,there is nothing worse than trying to lay bricks overhand from your neighbours side only.

I’ve worked on extensions where the neighbours wouldn’t let us step foot on their property meaning the bricks had to be laid over hand and you just can’t make such a neat job of it.Don’t forget you will be looking at that side more than he ever will.

My neighbours last project was to have solar panels fitted,and he asked for my permission to have some scaffolding on my path I agreed, and as a thank you he gave me 3 bottles of bubbly for my good lady,and 12 bottles of Ghosthip for me.😎👍
