Guidance actually states that officers should be aware of potential racial motivation as an aggravating factor anbd that hate crimes or racially mnotivated offences carry additional legal weight under the Crime and Disorder Act 1998 and Criminal Justice Act 2003.
That is a clear distinction based on nature of the offence not differential treatment of the victim based on ethnicity.
