Quite right?

It was deliberate imo and he was being an idiot. But the landing on someone was not intentional so probably correct as no assault.

Was there a civil claim? Can't see how he can avoid that one if so.

Let’s face it that was all this was ever about.

I remember when it happened and the Town fan was getting interviewed by every paper she could and how she was apparently getting nightmares and was struggling to cope from the incident etc. Don’t want to call BS but it was clearly from the start about her making a few quid.

Both charges ('assault by beating' and 'assault occasioning actual bodily harm') can be proven if the defendant is believed to have acted recklessly as to whether another person may be injured by their actions.

On that basis, I find it a little surprising that he was cleared, but I suspect the stated belief that he didn't know if he slipped or was pushed may have played a part.

Agreed. But a jury...

I feel it's a shame that there isn't better reporting (in the formal legal sense, rather than local news) of cases in general.

I would be very interested to read the closing arguments of the prosecution and defence here, to gain a better understanding of how each side presented their case, and what potential reasoning the jury may have relied upon in reaching their verdict.

I recall her being very disappointed that the club 'didn't even offer her a cup of tea'.

The bloke is obviously a bellend, and i don't doubt that him landing on her will have been a bit of a shock, but how the fook has this ended up in court?

Guess the problem is proving that going over was deliberate on his part. If the court had no better evidence than we do with the videos posted online, hard to prove.

The mere fact of a court appearance would, you hope, deter anyone from doing the same stupid thing deliberately in future, so not a complete waste of time and money if it prevents serious injury.

Isn't it about time the charging system was reformed so that there is a charge that fits the occasion. If there was a charge such as negligence causing A.B.H it would be rather more appropriate and have some chance of success. The current charges were never going to stick and am surprised that the C.P.S went ahead with it.

That would criminalise mistakes. Logically most car accidents could then be criminally prosecuted etc. intent or mens rea is a crucial part of most criminal offences for obvious reasons.

There is a boundary somewhere between negligence and mistakes and any good lawyer could exploit that, I suppose, but criminal negligence certainly applies in English law, particularly something like manslaughter where often the question of intent is doubtful and manslaughter is used as a fall back position.

There isn't. Not really. Negligence is almost by definition an error or mistake.

Criminal law already makes recklessness equivalent to intent in certain instances

Personally I think it was reckless. But persuading a jury that is the case, beyond reasonable doubt, is tricky.

I think negligence in many cases goes far beyond mere mistake or error.

Another huge waste of court time and money. Yes, the guy was an idiot & probably had a few drinks too many, but this was so unlikely to get a conviction through a jury, and probably rightly so. Juries tend to judge behaviour, rather than focus on the facts.

I think we have all had nightmares thanks to that game, nothing to do with anyone falling on us!

Sad thing is, that was the last Ipswich game my late father watched on TV. He was not impressed with that! He passed away not long after and missed the promotion.
