I think the whole thing is going to be massively problematic. There is a lot of feeling here that this could be Digital ID for everyone via the back door. Will be interesting to see how this unfolds.

I just cannot see how the public would accept some of the enforcement options they are looking at. I think the Bill says that Social Media companies cannot ask for verification direct but from a third party. It's ridiculous ...

That then brings in possibilities of fraud/scamming/theft of data if, say, a credit card registration is required (have seen that on things as innocent as football stats sites).

How do they plan to prosecute organisations entirely based overseas to Australia? Particularly those in countries with a record of ignoring that kind of thing (e.g. Russia).

Blocking individual websites - like TWTD - would require a lot of infrastructure and monitoring, especially in the age of VPNs.

I think it's a great idea in principle and might actually be helpful as a backup to parents struggling to limit a childs online activity.

But agree the enforcement is problematic.

Why not just make it illegal for a child to be in possession of a smartphone. For parents wanting to keep in touch, go back to Nokia brick phones, pagers and tracking devices.

Nearly every brewery/beer site on the interweb enforces an over 18 policy.

They put the responsibility back on the user, if you proceed to the site after the challenge prompt confirming you were 18, if you are then under 18 and were lying you are then breaking the T&Cs of access to the site, which legally covers them it would seem.

Same with Instagram which already has age restricted content, you confirm your birthday, if you lie or fake it, you've broken T&Cs of the account.

The reality is it helps nobody, other than make some busybodies feel smugly satisfied about making a difference.
