I don't know why they haven't used this in the trial, ut completely underlines his defence.
The issue is they have ruled on this already in the blurred lines case where it was deemed copy right infringement due to having the same "feel"...... which shows a complete lack of understanding of music.

Axis of awsome rule though
To be fair though, having watched Rick Beato's analysis, the staccato rhythm of Gaye's original verse section is quite unique and I think it's not by accident Ed's section sounds identical. But then it's a standard rhythmic structure, which I think would be ridiculous to say "once one artist has done it, that's it - no more!"

Of course there are extremely common chord progressions, and of course Axis of Awesome do a great job, and of course analysing music and/or comedy to the Nth degree kills a lot of the enjoyment.
However, making this point in relation to this copyright case is entirely misplaced, as the relevant part of the Gaye song DOESN'T use this chord progression. So pointing out that just about every other song does so is rather unhelpful to Ed's position!
