| Villa suing Carragher on 09:32 - Oct 31 with 1182 views | Guthrum | It would be interesting to know upon what legal basis they intend suing him. For slander or libel there would need to be proof of significant damage to the club, for example financial losses resulting from the comments. It also has to be shown that the statement is untrue. I hardly think that a few partisan comments on a podcast could have reduced the value of Aston Villa FC or in any practical way damaged their reputation and standing in the English game. Or that they could prove that historically and globally ManU are not by some margin the more prestigious of the two clubs (the essence of what Carragher said). | |

Absolutely no prospect of it going anywhere frankly.

Imagine being a Villa fan and seeing that from the club. I'd be embarrassed. What next? Suing a whole away end because they sung that "Villa is Sh1t"

Exactly that. Very embarrassing indeed. Man U being a bigger club than Villa is hardly controversial either; they must be in every metric: honours, value, ground size. This just looks like insecurity, which is the opposite of how you’d expect a top club to react. They’re big and historically important, but they’re not at Utd’s level.

This absolutely hits the nail on the head, both legally and as a matter of common sense. It's often thought that the law proceeds on the basis of technicalities, and yes of course that /can/ be the case. But in respect of libel, the questions are actually very in line with common sense, because you're trying to ascertain how a reasonable person would interpret the comments, and then what the effect of the comments (as so interpreted) would have on reputation. Yes, he's a pundit, and he's giving his /opinion/. In saying that Emery would want a particular job, the meaning of that phrase is clearly "My opinion is that he would want that job". There's no way anyone would interpret Carragher as stating some kind of inside fact that he's become aware of, that Emery actively 'wants out', and wants to go to Man Utd. It wasn't being expressed as 'breaking news' that Emery wants out, just as a pundit's view of what Emery would probably fancy. Then of course, you have the equally important point that the statement must lower someone's reputation in the eyes of the public. Whilst that provides an excellent opportunity for us to make a joke about only a lunatic wanting the Man Utd job, it hardly lowers the reputation of a football manager in the eyes of the objective reasonable person (who is neither a Villa nor Man U fan), to say that they would like the chance to move to a bigger, richer, historically more successful club. When Big Ron wound up in the Villa job, it was hardly because his stock had /risen/ and he was able to get a much better job than he had earlier had at United. He had been sacked by United and worked his way back to the top of the English game, doing pretty well with Villa. Equally, Emery wouldn't be at Villa if he hadn't been sacked by Arsenal, a bigger club. I can't see a world in which Villa sue. There might be a letter sent in order to extract an apology, but this really is a toys and prams situation. Silliness. I can understand Villa's frustration with the Premier League system and ecosystem. They were becoming successful and had to sell some really good players in order to comply with the rules (rules which others appear to be disrespecting). If they also were to lose their manager, a key part of their success, it just underlines the inevitability of quality going to "big" clubs, preventing the next tier of clubs from genuinely competing. Carragher's assumption that anyone would want to use club's like Villa as a mere stepping stone is probably correct, but also depressing, and I can understand why it touched a nerve. But there was an opportunity to make Villa's case genuinely and passionately, and try to win public opinion round. If they really had to say something at all. Spitting out the dummy achieves the opposite.

Tho it is also true that Villa are not seeking to dismantle that system, to make it a genuinely level playing field for all, but instead merely to place and maintain themselves at its apex. To join the "big clubs", not to overthrow the whole concept. Also, clubs are not "big" purely due to financial clout, but through decades of sustained achievement. Part of the anger at Man City is that they have sought to build an instant legacy by financially cheating the system, not through hard work. Whereas Liverpool, ManU and Arsenal have had many generations of large-scale, avid support. The Abramovich era has cheapened Chelsea, not enhanced it. Spurs are still considered a "big club", despite their recent struggles. That's why Ipswich still have recognition far beyond what our performance over the last 30 years would really justify. Similarly the likes of Forest and Leeds.

| Villa suing Carragher on 13:00 - Oct 31 with 506 views | NBVJohn | Utterly ridiculous of course, but it highlights the problem with modern day media coverage of football. The only clip of this programme I have ever seen is this one and I’m happy for that to remain the case! This is fantastic for ‘Brand Carragher’ there’s money to be made and attention to be gained from being a pig thick inarticulate gobsh!te with strong opinions. He effectively just told a historically significant football club to ‘know their place’. It’s almost as pathetic as the argument I keep seeing on social media that Manchester City somehow did football a favour by cheating as a means of infiltrating the cartel of big clubs. I guess that the idea is that I’m so enraged that I’ll call a premium phone line for a rant and be dismissed by an ‘expert’ for the entertainment of millions of listeners. I’ll keep my money and dignity thanks. Shame on the people that watch and perpetuate this drivel. | | | |
