I can see why some might think the police were stopping her cos she’s black.

I can see why she might be fearful of getting out the car cos police don’t like black people*

But if she had got out of the car when asked (as I would, but I’m white) then none of that would have happened.

The policeman didn’t seem racist in what he said, but who knows about his assumption behind stopping her?

Edit *I mean that for the sake of argument not as a blanket comment on all police.

Edit 2: the locking her up for 18 hours just seems like retribution for giving them a hard time.

Edit 3: I’m gonna get it now innit.

She could have complied but I think that's a different point for me. I find the justification he uses for searching the car incredibly flimsy and it reminds me of something I've seen before where police talk about "bad areas" to basically justify whatever the hell they want.

Racist? Impossible to tell. Yeah he wasn't calling her a n*gger or whatever but that isn't really what most people mean when they are talking about racism, at least from my experience.

He also decided pretty quickly that her not getting out of the car meant she was definitely hiding something in there.

So, from having windows that were slightly too tinted but weren't anyway, we're now nearly at accusations of possession/dealing of drugs, stolen property, firearms, etc.

All Makes sense Dan, although the copper said she was stopped for the tinted windows which aren’t allowed, so he’s on fairly solid ground there I would have thought.

The bit that doesn’t add up on the ‘this is a dangerous area’ excuse is that she’s a she and clearly middle-aged.

In onse sense that's fair, but in another can you imagine any copper with any person who refuses to get out just saying 'oh alright then, off you go'?

Highly unlikely.

The metro gives a few details that are not in the Guardian report

https://metro.co.uk/2020/06/18/nurse-calls-greater-accountability-police-stop-se

In particular the guardian says that the police pulled up in front of her, whereas her account of it is that 'they did a hard stop, I thought it was a hold up' , so it wasn't just that she wouldn't get out because the police don't like black people, which in itself is a reasonable fear, but she actually feared she was the victim of a hold up.

The offence is a very minor one if at all (it wasn't) and carries a penalty of £60. Ramping up a simple conversation to threats of detainment and being searched is way OTT in my opinion. The police could've measured the window tint without her getting out of the car, or issued the penalty by taking her plate number.

But they chose not to.

The lady was suffering from PTSD so her reaction to intimidation is understandable. Although being part of the police can be a very difficult and stressful job, they might find it less so if they acted less aggressively to normal, harmless folk like this lady.

Except on closer inspection the windows were within the allowance.

In other words, they were fine.

You have to question why someone doing nothing wrong is stopped by the police on their way home. As you say, not likely to be up to mischief is she?

in the video her behaviour was odd and clearly obstructive. i don't see that the police officer was left with many options - 'fair enough, don't bother then' isn't really an option.

Indeed- puts the police officer in an impossible position. They cannot just let it go once she refuses.

Whether it was a justified stop in the first place is something to consider carefully with all the facts.

Whether one can infer racism, I think is difficult. White people get stopped for driving with tinted windows too- and would undoubtedly have similar initial treatment if they refuse to get out when asked.

We are in a tricky place with all this. There are clearly issues to be addressed- though I think far more so in the States. We need to be very careful about inferring racism in every interaction with police that doesnt go well.

Again fair, but to my knowlegde they always ask you to get out when stopped - certianly when I've been done for speeding or for a search (way back when I looked young) thats been the case.
