If he stopped after the original fracas then you'd have a point.

Doubt he'll be allowed to go if it's confirmed as being him in the clip, even if only because the whole thing will turn into a furore that diverts from the actual cricket, which he himself then wouldn't be able to concentrate on anyway.

Stokes was out of order at the end of the video without a doubt but I think there is a great deal of hysteria talking about 5 years in prison etc.
IF he is charged and assuming it is with ABH (as he was arrested on suspicion of) then it will most likely be a category 3 offence (less harm lower culpability) or at worst a category 2 (less harm/high culpability or serious injury). Based on cat 3 the maximum prison sentence is 51 weeks, for cat 2, 3 years with a starting point of 18 months. Given a third deduction for early guilty plea and when considering his circumstances, mitigation and aggravation of the offence (someone did try and bottle him) it would most likely be suspended. If he is found (more likely pleads) guilty and nothing else comes to light I'd go for 12 months suspended at worst.
As for what happens cricket wise that's another thing entirely...
