Dear oh dear

NZ Blue
Poll: Who stays? Who goes?

(No subject) (n/t) on 11:35 - Sep 28 with 8274 viewsGlebeTractor

If my friend was being bottled, yes, obviously most people would get involved and try and stop any serious or further injuries from occurring.

Now, saying that. Stokes "OVER" (Sorry had to do it) stepped the mark.

There is a point where the attackers backed away and turned defensive.

At this point, the job is done. Stokes is held back, but carries on, completley out of control.

It's damning.

He will go down IMO.

Maybe he should take up boxing with Rio though?

Drunken punch-up basically.

I assume that's Hales trying to stop him. Doesn't try that hard really but that's not his job.

Mmmm. I find it a bit strange that if this were a footballer he would be called a "nasty thug" by everyone.

But as it's a cricketer it's just a drunken punch-up or self defence.

Stokes will do time for that continued assault.

Think I've been pretty clear in my post that he went too far, he's clearly in a lot of trouble.

All the facts not yet known of course but he could have walked away after the initial scuffle.

I just see some goon windmilling in the street. Start throwing punches like that in Chantry and you soon know what's what.

0/10 would not watch again.

Agree 100%, he totally lost it and can't see him avoiding a prison sentence...

We'll miss him hugely down under that's for sure, stupid lad...

Due process is always helped by flogging the CCTV footage to the Sun rather than giving it to the police.

Just imagine how much crime goes unreported that isn't caught on camera.

Let's hope it doesn't affect his bowling.

Hardly surprising.

Caught a snippet of someone speaking on the radio earlier, saying Stokes needs a bodyguard when he goes out because he's a 'target'.

Not sure about that. He just needs to not be hitting people more than absolutely necessary.

The only way he won't go is if there's ongoing legal proceedings.

If he’s charged and it goes to trial it can be 5 years in jail.

The media have properly shafted him here

Sounds like he was actually standing up for a bloke being verbally homophobically attacked. Stokes jumped in and the bloke threatens him with a bottle.

Well done Stokes. If that is indeed the case, he did the right think in my opinion.

I'm not disagreeing with you, but have you seen the video?

Where did you read this btw? (Comments about homophobia). Just so I can see for myself please.

You can't continue hitting and stalking someone after the job is done which is what he did.

If he stopped after the original fracas then you'd have a point.

Yeah I've seen the video and it looks bad but the other guy even when backing off could be saying something I guess

When backing off he could be saying anything. He could be apologising for all I know.

Thing is, Stokes is a professional sportsman and as such is likely to have far superior strength to the average bod in the street.

For the 1st few seconds I was on his side, but after that, he became the perpetrator, the bully, the thug in the video.

If he can't control himself then probably best he doesn't go out on the beer.

"saying something" simply isn't justification for physical assault. Just isn't.

They were backing off and one clearly had his hands up in submission.

That doesn't wash beyond the initial exchange.

Quite - it's a question of "reasonable force", and he steps over the line by continuing the force unnecessarily as the 'opponents' back away with hands up.

Doubt he'll be allowed to go if it's confirmed as being him in the clip, even if only because the whole thing will turn into a furore that diverts from the actual cricket, which he himself then wouldn't be able to concentrate on anyway.

They've both already been ruled out of selection.

He's on the front page of all the red tops mocking Harvey Price. When you're down People will come out and kick you further. Why on earth do these sportsmen do things like this??
I know, why don't you film me taking the p1ss out of a disabled child? It will be hilarious and never get out in the public.

Have they? I thought they were not available for selection until further notice. Isn't he still on the ashes ticket?

Yes, until further notice effectively covers today's match only. And then what happens next will be determined by the decisions of the police and CPS I suspect.

Doubtful. Unless he's got previous a custodial sentence for ABH is pretty unlikely.

Stokes was out of order at the end of the video without a doubt but I think there is a great deal of hysteria talking about 5 years in prison etc.

IF he is charged and assuming it is with ABH (as he was arrested on suspicion of) then it will most likely be a category 3 offence (less harm lower culpability) or at worst a category 2 (less harm/high culpability or serious injury). Based on cat 3 the maximum prison sentence is 51 weeks, for cat 2, 3 years with a starting point of 18 months. Given a third deduction for early guilty plea and when considering his circumstances, mitigation and aggravation of the offence (someone did try and bottle him) it would most likely be suspended. If he is found (more likely pleads) guilty and nothing else comes to light I'd go for 12 months suspended at worst.

As for what happens cricket wise that's another thing entirely...
