Was it even offensive? Anyone that's played team sports will celebrate in similar fashion.

Games gone.

No worries, apologies if I misread this as you advocating prison;

"I’d have thought there is an argument for prison given the fact it’s a sexual offence."

We seem to be on the same page then. 😊
[Post edited 20 Feb 13:46]

The argument for prison is bewildering as is setting a precedent in the same breath. Imagine the already over crowded prison system if prison were to become precedent. Madness.

Not sure what those on the General forum who moan about money and politics would make of having less money in their pocket to cover an inevitable rise in taxes to support overflowing prison systems.

Rubiales wasn't a teammate or the manager. It wasn't in the heat of the moment. It wasn't consensual. He did lie, he did then put women at the front of his conference to coerce support, he did get others in the Spanish FA to coerce Hermosa and other female players. He's got away very lightly for sexual aggression, lies and coercion.

Off all of those points, you could def argue it was heat of the moment.

He was acquitted of coercion. As were his colleagues.

He did wrong, he's been punished.

"If it was completely spontaneous how did she give consent?" Honest answer - if it's genuinely reciprocal. Didn't seem to be in this case

Earlier in the case his counsel tried to show consent via speech interpretation of what was said. Was not enough to swing the case, but might have impacted the sentencing ?

In the heat of the moment, on the final whistle, he grabbed his crotch to celebrate whilst standing next to the queen of Spain. Probably not punishable but not a great look. The medal ceremony was some 40 minutes later.

Medal ceremony may have been 40 minutes later, but that's still a moment in itself, you're celebrating with every player.

The crotch thing agree not a good look, but that's not what he's been charged for.

Agreed, grabbing his crotch (if that's what he did), isn't a great look. But that's a separate matter.

The trophy ceremony is very much celebratory and heat of the moment, celebratory moments are not limited to the final whistle.

Happy to agree to differ.

Just because he kissed one person, doesn't mean its not heat of the moment.

He didnt, however he had a much more virbant celebration with the captain of the team which clearly lead to him over celebrating with her compared to the others.

IF there was any previous talk of him stalking her etc then i'd say it was targeted in a negative way, but it's clearly the president over celebrating with the captain of his nation, silly thing to do yes, but shouldn't have turned into the witch hunt after, which lead to him panicking and making up lies to cover himself.

Would you consider it a lenient punishment if Hermoso had kissed Rubiales without consent and he had taken her to court?

I dunno. It’s hard to imagine that happening or her then making the same arguments/ behaviours he did from the off.

Would you consider that a rather pathetic bad faith hypothetical? It’s not like the power dynamic or context is even the same there anyway.

Hermoso wasn't the captain (not that it matters too much) . There wasn't a witch hunt as many millions of people were witness live to unacceptable sexual aggression.

I get the power dynamic arguments, although I genuinely don't believe that was at play here. I think it was just a spontaneous (very ill judged), joyous, world cup winning celebration.

The guilty verdict is what Hermoso and her supporters wanted, and that's been achieved.

Many of those millions don't believe it was sexual aggression, rather a (very ill judged) display of celebration by one party. It was inappropriate, but I wouldn't see it as aggressive.

At least it has now drawn a line for anyone who was in doubt.

It would be a dull forum if we all agreed though. 😊

Personally I don't think many millions cared. It was only the media once again that turned it into more.
