The Graun has this from someone who at least sounds like they're conversant with the law, but I stand to be corrected.

It’s maybe worth pointing out that Section 44 of the Serious Crime Act 2007 abolished the old common-law offence of incitement and replaced it with encouraging or inciting an offence. This requires the prosecution to prove both an act capable of encouraging or assisting an offence; and an intention to encourage or assist its commission.

That is, it’s not sufficient to prove that posting the image might, or even probably would, encourage violence against Farage. The prosecution would need to make a jury sure that, when he posted the image, Polanski actually intended to incite someone to try to kill Farage.

Section 4 of the Offences Against the Person Act 1861, soliciting murder, similarly requires an intent to encourage someone to commit the murder.

Possibly sharing the image might have constituted sending a menacing communication under section 127 of the Communications Act 2003 but, again, the prosecution would need to prove that, at the time he sent it, Polanski was aware that there was at least a risk the image would create fear or apprehension in any reasonable member of the public who saw it.

In other words, the case was a non-starter from the very beginning and Reform must have been aware it was.

Probably correct, but it was still a dumb move from Polanski to post it, and yes, he should have apologised because it was obvious Farage et al would exploit it for all that it was worth. Especially as a distraction from £5m and Posh George, and feeding in to their permanent feeling of victimhood.


Not only that, but they’d also have to treat the other 130+ accounts that posted the image the same, investigate them all and also charge them if they were under UK jurisdiction. Otherwise we’d have two tier justice, and I’m sure people wouldn’t want that.


(It was utterly daft to repost the image, the response by Reform has been utterly daft and the mental gymnastics on display by both ‘sides’ of people online has been pretty daft too. It’s a good distraction from the growing number of investigations into Reform finances though).

Maybe a desk job would be better just as my father did his national service in Singapore in the Royal Army Service Corps, safely away from the armed conflict going on in the rest of Malaysia.

Laughable. There is zero aggression here. I genuinely couldn't be calmer. A nightmare? Absolutely not. Someone who differs from your opinion? Clearly, yes.

I also love the reference to 'mental gymnastics', when there's a gaggle of wildly left-wing people on this forum who'd give the Gadirovas and Max Whitlock a run for their money on the floor, all in the pursuit of maintaining their position as 'good people'.

In this thread alone I've read people argue that a man carrying a knife, a hammer and petrol wasn't really a concern because:

1. It was the summer holidays.
2. He only wanted to cause a scene.
3. He wasn't getting any help with his asylum claim.

I haven't left any facts out. I simply don't think any of the above changes anything. To most normal people, it wouldn't either.

Anyway, I really must get on. I've made the same mistake I made before by going against the grain on this forum. I don't know why I do it to myself sometimes, it's a really odd little place.
