If defence lawyers could gain a mistrial from their own misconduct that would be a major flaw in legal proceedings wouldn't it?
However, my fear is that he might have comebacks against them himself. If he has to pay so high damages that any comebacks are minor in comparison it is OK I suppose but if he can successfully sue them for the damages he has awarded against him then he effectively gets away for free. | |
