The dark side of the Joey Barton circus on 11:24 - Jan 17 by JackNorthStand | I haven’t dismissed that at all. People can be hurt by comments that are made by someone being an “ idiot “ just as they can be hurt by “ hate speech”. I don’t believe Barton was trying to create hate. I think he has just been an idiot and trying to be outspoken as he is prone to doing. |
Barton is plainly stirring hate. Likening people serial killers for daring to be women on the telly is hate speech.

You have dismissed her testimony, though, by saying stifling his right to free speech is worse. And if you think calling someone an idiot is the same as hate speech, which includes things like racism, homophobia and misogyny, then you're beyond help.

I think that's where he is going to be honest. I think his football career is well and truly over so he is now planning on becoming a conspiracy grifter a'la Russell Brand, Andrew Tate et al

The dark side of the Joey Barton circus on 13:19 - Jan 17 by ArnoldMoorhen | I think that in your original (edited) post, and to a lesser extent in subsequent replies, you, mainly spoke out to defend Barton's "right to free speech" rather than show any understanding of: Why what he said went beyond the bounds of reasonable free speech. Why it inflamed a wider circle of Twitter trolls, some of whom may be stupid enough to take action against Eni Aluko in real life, or at least give her cause to fear that that might happen. And went so far as to say that the worst thing in the whole debate was not the fear and sense of threat that Eni Aluko is being put in, but people responding to Barton, which in your opinion is stifling free speech. You haven't upset me though, it's just that I try to speak out against hate speech at every opportunity. Barton engaged in hate speech, so I will politely explain why to anyone who seeks to defend him. |
No worries. I’m not out to upset anyone and not out to antagonise anyone. Different views such as mine and yours are what makes the world go round as long as we are respectful

You have misread what I posted. I was implying that Barton is an idiot. To clarify - Whether it is hate speech or him being an idiot ( typing things out that are rude and poorly thought out ) both are able to cause offence. What is it you feel I am beyond help with ? [Post edited 17 Jan 2024 14:28]

You seem beyond help in understanding that what he's said is not ok, regardless of if he's just being an idiot or intending to spread hate. It could also be both. They amount to pretty much the same thing and I'm baffled why anyone (let alone a Town fan) would be defending him or his right to post this stuff that is making women fearful.

Fair enough mate I hear your point of view. For the record I’m not defending g Barton I’m taking a broader view that people shouldn’t be silenced even if they are morons. Let’s draw a line under it

I would generally agree, but there's a line. I wouldn't agree that freedom of speech means people can say whatever they want. Certainly, if it's something that harms, or potentially harms, a vulnerable group, or emboldens a hateful group, I'm quite happy for that sort of thing to be silenced.

That’s the thing - free speech has limits and always has done - libel and slander has been ‘a thing’ for centuries. The Joey Barton’s of the world is generally supported by the ‘they’re are only saying what we’re all thinking’ which is a nonsense. Decency is subjective to society and what Barton has said flies over accepted standards. True, he’s free to say what he wants but there is a price to free speech. If mainstream news outlets want nothing to do with him then that’s down to them - he’s not being cancelled as he can still mouth off on Twitter or GB News etc. And if football CEOs do not wish to employ him then that’s due to his past incompetence. He’s not a great manager and hasn’t achieved that much success.

I don’t want to shock you but, expressions of hatred toward someone on account of that person's colour, race, sex, disability, nationality (including citizenship), ethnic or national origin, religion, gender reassignment, or sexual orientation is forbidden. Nothing you can do about it, it’s the law! Phil has some T&C’s that cover this sort of thing as well, he even has a banhammer. Moron’s don’t have a get out clause, here or in the courts. Stating “Sorry m’lud, I’m a thIck ex-footballer”, won’t be the basis of a good defensive strategy.

This does not appear to be the case as misogyny is not a hate crime. The following is a summary from the Law Commission's 2021 report on hate crime so far as it relates to sex and gender, and the Government has not adopted their two proposals at the end. "The Law Commission has recommended that “sex or gender” should not be added to the protected characteristics for aggravated offences and enhanced sentencing as it would be ineffective at protecting women and girls and in some cases, counterproductive. For example, if applied in the context of rape and domestic abuse it could make it more difficult to secure prosecutions and create unhelpful hierarchies of victims. However, if these contexts are excluded, it would make sex or gender very much the poor relation of hate crime characteristics, applicable only in certain, limited contexts. However, the Commission has made a number of recommendations to provide greater protection: Extending the offence of stirring up hatred to cover stirring up hatred on the grounds of sex or gender. This would help to tackle the growing threat of extremist misogynist “incel” ideology, and its potential to lead to serious criminal offending. A government review of the need for a specific offence to tackle public sexual harassment, which would likely be more effective than adding sex or gender to hate crime laws." But even if there were an offence of, say, stirring up hatred on the grounds of sex, the threshold for the commission of such a criminal offence might be quite high. [Post edited 17 Jan 2024 20:56]

Although that defence didn't do Harry Redknapp a lot of harm in his defence against tax fraud allegations either!
