The president nominates them, then there is a committee that asks them questions to make sure they are suitable (that is effectively pointless) and then they get a job until they die. They have a serious amount of power which had not been used before as judges were not as overtly political as they are now. The idea of having a politically aligned legal system is completely bonkers to me. |  |

I suppose the criticism of judicial appointments in the UK is that they represent a particular (high) class, but I am not sure that makes much difference in practice. And at least they aren't appointed for their political stance. [Post edited 15 Jul 2024 21:51]

I hear you...but in a functioning Judiciary system, yes I know this whole thread is calling this out. A certain previous president has to answer for having a load of classified files. If the Judiciary are making decisions based off political leanings that is surely not a functional democratic nor legal system? As a lawyer, you're preaching to the converted because I believe that justice must not just be done, but must be seen to be done. The US fails on that measure but I suppose it derives from a constitution drawn up before the Republican and Democratic parties came into existence. [Post edited 15 Jul 2024 22:14]

(I'm not a Lawyer) However from my limited understanding, this ruling basically overturns a lot of case law and previous cases allowing Special Councils to be appointed. Which will be a key issue to be debated legal wise. I assume there are specific considerations in this case but Trumps team have not challenged Jack Smith's appointment so far in other legal actions. It really is amazing or maybe not, once an individual has funds behind them...how you can defer criminal cases for years. Trump has form for this as we know.... |  | |  |

I have read the Supreme Court judgement, and dissenting opinions. (Interestingly I think there is still a route for Capitol Protesters to be charged if prosecutors can demonstrate that the Capitol Building is an "object used in an official proceeding" in the context of the meeting of Congress to ratify the electoral college vote.) This case is about the documents seized from Mar a Lago after Biden had taken office. I haven't read this judgement. |  | |  |
