In principle I agree with you but I think it may depend on the context. The offence with which he has been charged is under section 5 of the Public Order Act which reads as follows. "A person is guilty of an offence if he– (a) uses threatening or abusive words or behaviour, or disorderly behaviour, or (b )displays any writing, sign or other visible representation which is threatening or abusive, within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby." Had he been at a Man Utd v Liverpool game then it would seem to me that the latter part of the offence may well be satisfied, but that is arguably less likely to be the case at a Man Utd v City game, especially as the meaning of the T-shirt may not be obvious to all. But it does suggest that it would be possible to be arrested and charged with an offence if walking about Ipswich with a "F8ck the Tories" T-shirt, which does seem to go too far. Ultimately, the offence appears to leave a great deal of discretion to the police, which is not necessarily ideal. [Post edited 4 Jun 2023 21:00]
