It has certainly been going on for a very long time, and I think that the problem is that the constitution was drafted at a time when political parties weren't envisaged. Political parties are not mentioned in the U.S. Constitution, which predates the party system, and had they been envisaged, it strikes me that something would have been put in place to prevent political judges etc. As regards Roe v Wade, that was reached when there was a Democrat majority on the Supreme Court, and reversed with a Republican majority. Both setups, in my view, are wrong because it suggests political judgment is influencing legal judgment. [Post edited 22 Jan 15:38]

You've missed the point. Doesn't even need to be anonymous, if someone (Trump) holds N amount of his coin and someone else says they will drive the price up in exchange for something (you can use your imagination here) so that Trump makes X from the volume he holds then it's an easy way to formulate a bribe. Good points. I take note of your point in the final paragraph, but would counter that however you feel about the two parties independently you could argue that the Republican appointed judges tend to have a textualist interpretation of the constitution, whereas the Democrat appointed judges tend tend to have an originalist interpretation. In my view you have to follow what the words actually say rather than what you think they mean in the modern context. Roe v Wade was a poor ruling and was rightly repealed regardless of the moral arguments on either side. The law should be changed, and if that cannot be agreed upon, then this issue is not something that the supreme court should rule on. |  | |  |
