One of the many problems with this case is i can't imagine a situation where if the other bloke had started punching his MP then carried on giving him a kicking on the ground he wouldn't be facing a custodial sentence. If I had been caught on cctv doing what that MP did I just couldn't imagine not getting a custodial sentence. I think if the other bloke looked like he was going to hit him it might be a very different story. But in the video I'm sure he's being a annoying tw4t but don't think that justifies yer man's reaction |  | |  |

If the other guy looked like he was going to hit him he wouldn't even get convicted as it'd be self defence. Assuming you have no priors, I'd be surprised if you got a custodial sentence for a first offence of this nature. I'm not sure what the value of that would be, a suspended sentence is a deterrent and means you will have a community order of some sort alongside it to address the behaviour. We can't keep locking people up. |  |

I'm not keen on locking people up for petty crimes myself. But I'd feel a bit different about acts of violence. If any if us were for example giving out to our local MP about the state of the roads etc and he started lashing out, as victims I think we would be looking for the perpetrator to face a custodial sentence. I don't mean a long sentence either. Think 2-3 months would be enough to put manners on him. Just don't think it looks good for someone to be committing quite violent acts and getting away with a slap on the wrist and keeping there 90 grand a year income |  | |  |

It's in his constituents' hands for him to lose that salary though and I suspect that will be the case sooner rather than later. I think the reason he was initially given the custodial sentence was to reflect his profile as an MP, I doubt a similar incident on a night out would have attracted an immediate custodial sentence rather than a suspended one or even a community order. It's not one I'm overly bothered about, I think sending him down would be on the harsh side and the new sentence feels more proportionate to me but I wouldn't have lost any sleep over him doing a 10 week stretch either. |  |

I agree it's a sorta border line case. 10 weeks may feel a tad harsh but community service and no custodial sentence seems a bit lenient. Judge stuck between a rock and a hard place really. Though at the same time, if any of my friends or family had been attacked like that by some p1ssed bloke. I'd be far from happy with them not recieving a custodial sentence. ....people get so entrenched in their "politics" that they can't think impartially. To think that the correct punishment for punching a non threatening member of the public to the ground and then repeatedly punching him and threatening him will he is on the ground merits nothing more than a few weeks off the booze as punishment is ridiculous. Add in the fact that he lied in his statement, then plainly he should have done a bit of bird, but because he represents your fave political party he should apparently be let off. I think Herbers is right in this case. The "norm" for this kind of thing is usually a suspended sentence and/or some community service. Me and some pals got in a street fight at uni and while we warned we might be looking at custodial sentences, at the end of the day none of us got put away. We all had clean backgrounds, promising careers, blah blah. So that seemed to work in our favour and got us some leniency thankfully. |  |
