It doesn't have much nuance to it to allow for any unusual situations. I got divorced, and signed an agreement with my ex that she and the kids could stay in the house until the youngest was 18. I am still a part owner of that house, but am legally excluded from using it in any way shape or form. When I went to buy a new house, I had to pay the higher rate of SDLT (£21k instead of £5k) as it counted as a second home, despite not having any use of the other house. So I have some sympathy with the fact that she had to pay the higher rate, when she doesn't seem to just have a second home, it is there due to the exceptional difficult circumstances of her child. There are probably lots of people in the same boat paying the higher rate. |  |
