Jumping on someone's head isn't assault. Jesus Christ what goes on in your head?

I really don’t think he intended to fall down to the lower tier.

Think he got to the point of no return, can’t see why someone would intentionally do that, but how can it be proved it was deliberate?

I'm confused, why put "fell", if you don't think he intended it. Looked deliberate to me, for what it's worth.

Deliberately rolled down and off the roof.

He may not have known there were people immediately below - but he absolutely did it deliberately.

I think it comes down to the fact that the offence can be committed recklessly as well as deliberately.

If the 'man on the Clapham Omnibus' could reasonably foresee that his actions may result in injury to others, then there may be a reasonable prospect of a successful prosecution based on recklessness.

Surely 'fall' is exactly the right word if he didn't intend it?

Don’t have to prove it was deliberate. Reckless is sufficient. Bloke could have seriously injured someone. Deserves everything he’s got coming to him

From watching it live at the time he definitely did it intentionally. It was just luck no-one was seriously injured. Quite right that he should be charged and really not sure why it’s taken so long to reach that conclusion

From the CPS charging manual:

Battery / common assault

Section 39 Criminal Justice Act 1988 (CJA 1988)

Common assault is an act by which a person intentionally or recklessly causes another to suffer or apprehend immediate unlawful violence. Battery is committed by the intentional or reckless application of unlawful force to another person. These are two separate offences, placed on a statutory footing by section 39 CJA 1988. Where battery is selected it should be charged as “assault by beating”: DPP v Taylor and Little [1992] Q.B. 645.

Looking at the details of the article, it would seem to me that the chap was charged previously and it's now only coming to court.

There is a statutory time limit that proceedings must be commenced within six months of the offence having been committed (s.127 Magistrates Court Act 1987), so he would have had to have been charged by the end of July at the latest.

The quotes to me meant ostensibly. If it was without the quotes, then I would think sitters simply meant fell. The answer sitters gave makes if clear he was simply quoting.

It would be really difficult to roll on such a slight incline. Seems like assault is about right otherwise criminally reckless behaviour.

Not harsh at all. A 60 year old “grown” man deliberately rolled down the roof of the executive boxes and landed on a poor unsuspecting ITFC supporter and then punched one or two others?

Deserves everything he gets!

The idiot deserves all he gets. In the entire history of the Cobbold stand nobody has ever fallen down that sloped roof until Maidstone moron managed it. Just a shame he injured others and not just himself.

No, but I remember that idiot Pompey fan - "John Portsmouth Football Club Westwood" almost did when walking on the roof in the past. Stewards dragged him back into the stand.

Police said at the time they were taking no action, which surprised me as it was so obviously done on purpose.
