It should be a rational debate. By the letter of the law this offender should serve time in a women's prison as they have transitioned and have a gender recognition certificate. This is how recent legislation is now falling apart because we have an an example of the concerns shown at the time. The offender was on remand in a women's prison and the Scottish government only folded on this after an outcry. |  |

OK. I have no sleep loss over whatever punishment the 'lags' dish out to rapists and paedos who are in prison. However, what prison does this offender serve their time in? Put her in a women's prison and she is a clear danger to other women. Put her in a men's prison and if she is fully transitioned then they are in very grave danger of being passed about by other inmates for their own sexual gratification. I don’t think it makes a farce of the recent legislation does it? Wasn’t that more about the speed of the process (so wouldn’t necessarily stop this type of occurrence)? It’s a tough one to balance safety of fellow inmates v safety of the individual. I certainly wouldn’t want to be responsible. |  |

Former Governor of the Scottish womens' prison in question just said on BBC R4 World At One that she thinks the answer should be separate wings for trans people, which seems sensible & practical to me. |  |

Yes, if there was a cis female rapist of other females - would they be placed in a men's prison? Not sure there's an precedent for it which makes it tricky. I guess the argument around a convicted gay rapist being in a men's prison with her being a convicted lesbian rapist is slightly different because physically she is likely to be stronger than many of the cis women in the prison but that's probably the only difference? |  | |  |

Whilst I personally agree they should, at least for the time being, be put into a men's prison, it does raise some other questions about where you put sex offenders of any gender. If you had a male rapist who raped other men who were put in a male prison, I imagine some of the inmates would feel uncomfortable. If you had a female rapist who raped other women who were put in a female prison, I imagine some of the inmates would also feel uncomfortable. |  |

It is not clear to me that the recent legislation, which hasn't even come into force, has made any difference. The policy about prisons is governed by the UK-wide Equality Act 2010, and the same issues already arise in England, where women's prisons can house inmates who were born male but identify as female, regardless of whether they have gone through any physical transformation or have obtained a gender recognition certificate. https://www.bbc.co.uk/news/uk-57692993 [Post edited 26 Jan 2023 14:09]

There was a case recently where a woman pretended to be a man, met vulnerable women online and 'raped' them / conned them into sex using a sex toy. I don't know whether they were charged with rape, but it seems like rape to me. |  |
