I think it comes down to the fact that the offence can be committed recklessly as well as deliberately.
If the 'man on the Clapham Omnibus' could reasonably foresee that his actions may result in injury to others, then there may be a reasonable prospect of a successful prosecution based on recklessness. | |

Looking at the details of the article, it would seem to me that the chap was charged previously and it's now only coming to court.
There is a statutory time limit that proceedings must be commenced within six months of the offence having been committed (s.127 Magistrates Court Act 1987), so he would have had to have been charged by the end of July at the latest. | |
