If we won't pay that how is it accurate to say he'll be getting a £2m pay off? That doesn't stack up. They've done some fag packet maths, but we all know that there's no way he's getting the full amount of his 4 years paid up.

I'm curious if his flippant remarks about the takeover would be grounds for termination because of mishandling sensitive information? Surely there are some things that can trigger contract breaks without ramifications

Exactly. As well as break clauses that reduce the figure significantly I'd imagine there's an agreed sum or percentage in there for either party to terminate the contract early. I think Phil might have suggested at one point that he'd heard that if we sack him within the first 2 years of the deal we have to pay up 2.5 years of it but I might be misremembering the detail and I'm not sure it was presented as solid def info.


I'm sure there could be grounds for sacking without pay off after his attitude towards the fans, media and disrespect of the owner.
Slating his boss to the local radio is surely enough to sever any contract. Im sure Evans has decent lawyers.

Would a takeover make any current contracts void anyway?

I hope the new owners reward their new loyal fans who have been funding the club during lock down. Not waste money paying off an under achieving fool.

No, on both counts.

Football managers don't get sacked for conduct very often. The bar for "gross misconduct" is incredibly high and football clubs seem to view it as counter-productive to dismiss managers through a structured disciplinary system.

Notts County tried it in 2017, sacking John Sheridan for threatening a referee with violence. He took them to court and got compensation:

Brighton also tried to sack Gus Poyet for gross misconduct in 2011, for criticising the owner in an interview. He also went to the lawyers and Brighton settled rather than go to court:

Non-league Grimsby seem to have successfully got rid of Rob Scott in 2013 through disciplinary proceedings. From the sounds of things it was because Scott was repeatedly violent and as a consequence they took him through a full disciplinary with internal appeal etc. It probably also helped that the money involved likely wasn't very much.

Lambert's employment contract is with the club, not Evans, so would still be valid. Just as well that's the law really, because otherwise if you were working for a company and it got bought out, you'd lose all your employment rights!

He has been careful to only say things that are already in the public domain albeit as speculation. He has not stated they are true but has clearly hinted towards them. It is important to note these are orchestrated remarks made in virtually the same words in 3 separate interviews. These are not slips of the tongue but carefully planned comments.

It is clear from his past that any dismissal would need an absolutely watertight case and he will pursue through the courts anything he is still owed. Ultimately, his pay off, however much it is, simply lowers the value of the club to new investors or comes from ME's investment.

Surely if a takeover is in the offering the last thing Evans would do now is sack on ‘his time’, making any payoff his responsibility financially. I’d have thought he’d leave things as they are and let the new owners deal with any payoff.

The information in the public domain is his salary and length of the term, which would total circa £2m. As you say there are clauses in place that limit the payoff. It’ll be closer to 1 years salary than 4.

If Evans genuinely, genuinely, gave him 5 years contract with a "payment in full if terminated early" clause then he's an absolute dope and fully deserves the massive loss he's about to take on 13 years of investment.

£500k is reported pretty much everywhere and another good source quoted Lambert as being on 3x the next highest salary which was £180k.

He won't get it though. It's just a stand-off now.
