Which means that two important situations are now clarified: A person with a penis can't assert female gender in order to serve a sentence in a women's prison. And A person with a penis can't assert female gender in order to gain access to a protected female space, such as a women's refuge. What it doesn't mean is that we can be anything other than respectful to trans people, including referring to them by their pronouns of choice.

A mate of mine who’s non binary was posting about how it was a good decision - but I guess the radical elements of the trans community will be the voices shared more widely. Schools will be a good litmus test for a few things too I suspect.

Should never have got this far, Govts of both colours have had the opportunity to sort this out without the need for it to go to court....the debate could be 5 years further ahead than it is. People merely stating 'Trans Women are Women' was never a valid position to work from, it needs careful thought and legislation not an attempt to just pretend it is that simplistic

This is probably the most important thing to stress here: 'Lord Hodge stressed that trans people are still protected under the Equality Act from discrimination and harassment.' Not that that will stop The Male Writer Robert Galbraith from spreading transphobia all over the place.

it's the equalitY act - which is what the supreme court was asked to rule on. in terms of rights in this area the equality act is the most significant piece of legislation and the supreme court ruling now gives a settled legal definition of a woman for the purposes of that act. the ruling has also emphatically reiterated the rights and protections for trans people provided by the same act. women, legally defined, benefit from sex based protections, which is what parliament always intended, and while trans people cannot claim those same sex based protections they do benefit from protections from discrimination and harassment associated with having transitioned. it is interesting though that in the past posting on here the very words from the thread title might well have got someone called a transphobe.
| And so as the loose-bowelled pigeon of time swoops low over the unsuspecting tourist of destiny, and the flatulent skunk of fate wanders into the air-conditioning system of eternity, I notice it's the end of the show |

indeed, and, as the court of appeal recently emphasised, labelling people who hold 'gender critical' views as 'transphobes' is discriminatory stereotyping. so he needs to be careful where he does it.

in response to the down arrow, if the court of appeal isn't good enough for you, how about the ehrc guidance (which in turn was endorsed by the court)?: "One particular species of [direct discrimination] in which an employee's holding or manifesting their belief might have a significant influence on their treatment is through the putative discriminator's adoption of a stereotype. In such a case, although the reason for the treatment given by the employer is not the protected characteristic, it is nonetheless positively relied on by the claimant. The claimant argues that the decision-maker has, consciously or unconsciously, adopted a stereotype and was significantly influenced by it in deciding on the treatment complained of i.e. on the basis that the claimant would share the perceived attributes of the group, rather than relying on evidence about the particular individual. If that is so then the treatment will be 'because of' the protected characteristic. ... In relation to religion or belief, a decision-maker will accordingly discriminate where the reason given for the treatment is significantly influenced, consciously or unconsciously, by a stereotype that persons who hold or manifest the relevant belief will share attributes of a group which they might not in fact possess. Examples of stereotypes in relation to religion or belief explicitly recognised in the case law [include] that persons who hold/manifest certain gender-critical beliefs have animus towards trans persons "
