It would seem that calling a police officer stupid and white is acceptable in today's society..

Imagine the uproar if that particular slur had been used against someone of BAME origin.. think the sentence and certainly reaction to it would have been different

Picking up on Robertson's reference to alarm or distress, it looks like what she was charged with had two elements.

Kerr pleaded not guilty to the offence of intentionally causing harassment, alarm, or distress to another by using threatening, abusive, or insulting words under Section 4A of the Public Order Act 1986, and to the racial aggravation of the offence per the Crime and Disorder Act 1998.

It's difficult to see how one of three policeman in a police station with two females could be said to have suffered alarm or distress by what she said (especially given that he didn't even raise the wording used for some time), so that may well be the clincher before going on to determine whether there was any question of racial aggravation, which would only kick in if the first element were proved.

As Robertson suggests, I am sure there are other lesser Public Order Act type offences she could have been charged with.

I think it'd be a good idea to avoid calling any police officer "stupid" for anyone pulled up by them who wants to minimise the consequent impact on their lives for the following few hours or longer though!

Sorry, I haven't really followed the case, and was only looking at the law, having been prompted to do by what Geoffrey Robertson said. And if I'm reading what he said, and the law. correctly, it is not clear to me that that the police officer suffered alarm or distress by what she said (as opposed to anger), which is a hurdle that must be crossed before you get on to racial aggravation.

Of course, it may be that I am talking out of my hat!

I think we’re talking about two different things. Anti-white prejudice exists in lots of places. It could be described as bigotry, hate or racial prejudice, depending on how it manifests. Doesn’t excuse it, or make it ‘only’ words or anything (though often - and probably in Brixton!? - it can be rooted in historical experience). But it is distinct from ‘racism’ as a globalised system of oppression which exists hand in hand with whiteness and white supremacy.

people interact regularly and they then slip into short hand forms because they know what winds each other. it is true in any setting. to be fair the thread also includes lots of reasoned debate and different views argued genuinely. overall a lot of it is quite an interesting discussion. but yes, people also bicker - such is, and always has been, social interaction.

I skim read them.

The video I’ve seen is a short snippet of what happened, and I wouldn’t like to judge based on such a short video.

A jury of her peers found her not guilty having been presented with the full evidence.

If it had been a white person saying it to a BAME officer there will have been outrage, and rightly so. People of BAME have suffered systematic racism over the years and continue to do so.

The fact that it took 11 months for the particular comment to be brought up is really telling.

This thread hasn’t even been that entertaining a read, do better TWTD.
