There is already an offence of damaging property which carries a maximum sentence of 10 years.
The point of briefing this to the Sunday papers was just a distraction from the right-wing riots and to try and create 'culture war' type arguments that the government can feed off of. There's no logical reason for Labour to oppose this as far as I can see, and if they did they'd just be walking right into the trap.
